Bike Provider Terms of Use
Introduction
These Bike Provider Terms of Service govern the use of the ThaiRide platform by motorcycle rental providers ("Providers"). By registering as a Provider, you agree to comply with this Agreement.
ThaiRide's role
ThaiRide operates solely as a marketplace platform connecting Providers with potential renters. ThaiRide is not a rental operator, an insurer, a transportation provider, or a party to rental agreements. Providers independently manage and operate their rental businesses.
Provider responsibilities
Providers are solely responsible for motorcycle ownership or authorization, vehicle registration, maintenance, safety inspections, insurance, deposits, passport handling, legal compliance, taxes, customer disputes. Providers agree to comply with all applicable Thai laws and regulations.
Rental contracts
Providers enter into rental agreements directly with Renters. Providers are solely responsible for preparing rental contracts, collecting payments, collecting deposits, verifying licenses, handling accidents, handling traffic fines, handling damages and disputes. ThaiRide is not responsible for enforcing rental agreements.
Passports and deposits
Providers may independently choose whether to request passport copies, retain passports, collect cash deposits, collect credit card deposits. Providers assume all legal and operational responsibility relating to deposits and identity documents.
Platform fees
ThaiRide may charge commission fees, subscription fees, advertising fees, promotional fees. ThaiRide reserves the right to modify fees with notice.
Provider content
Providers are responsible for the accuracy of listings, pricing, motorcycle descriptions, photos, insurance details, cancellation policies. Misleading or fraudulent listings may result in suspension.
Insurance
Providers are solely responsible for maintaining legally required insurance coverage. ThaiRide does not provide insurance coverage for motorcycles, renters, or third parties.
Prohibited conduct
Providers shall not post false listings, manipulate reviews, discriminate unlawfully, threaten renters, engage in fraudulent conduct, violate Thai law.
Disclaimers
ThaiRide does not guarantee booking volume, revenue, uninterrupted service, platform availability.
Limitation of liability
ThaiRide shall not be liable for lost profits, business interruption, customer disputes, theft, accidents, government actions, legal claims arising from rentals. ThaiRide's total liability shall not exceed the fees paid by the Provider to ThaiRide during the preceding three (3) months.
Termination
ThaiRide may suspend or terminate Provider accounts at its sole discretion for violations of this Agreement.
Governing law
This Agreement shall be governed by the laws of the Kingdom of Thailand. Disputes shall be subject to the exclusive jurisdiction of the courts of Phuket, Thailand.
